Terms of Service

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a binding legal agreement between you ("User," "you") and Card Butler ("Company," "we," "us," or "our"), a company organized under the laws of Switzerland. By accessing the website tcg-inventory.com, using the TCG Inventory web application, or using the Card Butler hardware device (collectively, the "Services"), you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICES. BY ACCESSING THE SERVICES, YOU WAIVE CERTAIN LEGAL RIGHTS TO THE EXTENT PERMITTED BY APPLICABLE LAW.

2. Service Description and "Beta" Status

2.1 The Service: Card Butler provides a cloud-based inventory management system for trading cards.

2.2 Beta & Early Access Disclaimer: You acknowledge that the Service is currently in a "Beta" or "Kickstarter" phase. The Service is provided "AS IS" and "AS AVAILABLE" with all faults. We make no warranties regarding uptime, data integrity, or the accuracy of card scans during this phase.

2.3 Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts and Security

3.1 Magic Link Access: Access is authenticated solely via "Magic Links" sent to your email.

3.2 User Responsibility: You are responsible for maintaining the security of your email account. Card Butler is not liable for any unauthorized access to your account resulting from a compromised email address.

3.3 Account Termination: We reserve the right to terminate or suspend your account if you breach these Terms.

4. Intellectual Property Rights

4.1 Third-Party IP (The "Fan Content")

The Service allows you to catalog cards from games such as Magic: The Gathering, Pokémon, Yu-Gi-Oh!, One Piece, and Lorcana.

  • Ownership: All card names, mana symbols, oracle text, set symbols, and card art are the intellectual property of their respective owners.
  • No Affiliation: Card Butler is an unofficial third-party tool and is not endorsed or affiliated with any TCG publisher.
  • Use of Data: The display of card information is for identification and management purposes only.

4.2 User-Generated Content (UGC)

When you use the Card Butler device to scan cards or manually upload images:

  • License Grant: You grant Card Butler a perpetual, worldwide, royalty-free license to use, store, and display your User Content for the purpose of operating and improving the Services (including training our recognition models).
  • Responsibility: You represent that you own the physical cards you scan and agree not to upload counterfeits or proxies.

5. Hardware, Pre-Sale Orders, and Delivery

5.1 Pre-sale and pre-order: Card Butler devices sold as pre-sale, pre-order, Kickstarter, early-bird, or similar early-purchase programs are not in-stock retail goods. You acknowledge that you are buying a product that may still be in design, tooling, manufacturing, quality control, or fulfillment.

5.2 Crowdsupporting contribution: Under Swiss law, a Card Butler pre-sale or pre-order is a crowdsupporting contribution (reward-based crowdfunding), not a conventional retail purchase of goods already manufactured and in stock. The Card Butler project is at an early stage. By placing a pre-order, you contribute funds to that project in exchange for a future reward — the device and related benefits — if and when the project is completed. Website and shop pre-orders are a continuation of the same Kickstarter campaign funding: they support the same early-stage project on the same footing as campaign backing, not a separate finished-goods retail sale. You acknowledge the inherent risk that an early-stage project may be delayed, changed, or, in exceptional circumstances, not completed as originally described. Where mandatory consumer law gives you a right you cannot waive, that right is limited to the minimum the law requires.

5.3 No guaranteed delivery date: Any advertised ship date, fulfillment window, or estimate is indicative only and is not a contractual deadline. Manufacturing, component shortages, tooling, quality control, freight, customs, carriers, and other events outside our control may delay delivery. In some cases, a pre-sale device may take more than one (1) year from the date of purchase to be delivered. By placing a pre-sale or pre-order, you accept that possibility.

5.4 Waiver of delay claims: To the maximum extent permitted by applicable law, you waive all claims arising from delayed delivery of pre-sale or pre-order hardware, including claims for refund, damages, specific performance, interest, or cancellation solely because delivery takes longer than expected — including longer than one year. Where mandatory law gives you a right you cannot waive, that right is limited to the minimum the law requires.

5.5 Shipping and risk of loss: Risk of loss passes to you when we (or our fulfillment partner) deliver the hardware to the carrier. We are not responsible for packages lost, delayed, seized, or damaged in transit, or for customs duties, import taxes, or refused shipments.

5.6 Limited hardware warranty: After delivery, we warrant that the hardware will be free from material defects for two (2) years from delivery, as required by Swiss law. This warranty does not cover misuse, accidents, unauthorized modification, normal wear, or damage to cards, sleeves, or other property. Except for that limited warranty, hardware is provided "AS IS" to the maximum extent permitted by law. You waive all other express or implied warranties regarding the device, including merchantability and fitness for a particular purpose, to the extent such waiver is allowed.

5.7 Use of the device: You use the Card Butler device at your own risk. We are not liable for damage to cards, sleeves, binders, or other property, or for misidentified, missed, or duplicate scans.

6. Subscriptions and Fees

6.1 No Refunds: Subscription fees are non-refundable.

6.2 Digital Performance: By purchasing a subscription, you request immediate access to the service and waive any right of withdrawal once access is granted.

6.3 Fair Use — Store (Gold) plan: The Store plan (also referred to as the Gold tier) includes unlimited scans subject to fair use. This allowance is intended for a normal trading-card store operating during ordinary working hours. It is not a license for continuous 24-hour scanning, industrial-scale or warehouse-style processing, or any use inconsistent with typical store operations. If we reasonably determine that your usage exceeds fair use, we may throttle, limit, or suspend scanning, or require a custom arrangement, without that constituting a failure of the Services.

6.4 Insolvency and bankruptcy: If Card Butler or TCG Inventory LLC enters bankruptcy, insolvency, liquidation, or a similar proceeding, unused subscription tiers, scan allowances, and prepaid plan time are not refundable. To the maximum extent permitted by applicable law, you waive any claim for a cash refund of those amounts. Any remaining subscription value will, where legally possible, be applied toward creating or maintaining a fallback service so that scanning functionality can continue for users rather than being returned as cash. This is a statement of intent and does not override mandatory insolvency law or the rights of other creditors.

7. Limitation of Liability and Additional Waivers

7.1 Cap on liability: To the maximum extent permitted by law, Card Butler and TCG Inventory LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, business interruption, or cost of substitute goods or services, even if advised of the possibility of such damages. Our total liability for any claims related to the Services or hardware shall not exceed the amount you paid to us in the last twelve (12) months or CHF 100, whichever is greater.

7.2 Additional waivers: To the maximum extent permitted by applicable law, you waive any claim based on: (a) scan, recognition, or matching errors; (b) pricing or valuation data; (c) downtime, beta defects, or discontinued features; (d) loss or corruption of inventory data; (e) delayed, lost, or damaged shipments, including pre-sale delivery taking more than one year; (f) customs, taxes, or import refusal; (g) damage to cards or other property from use of the device; and (h) unused subscription tiers or scan allowances in bankruptcy or insolvency, which are not refunded in cash.

7.3 Class and representative actions: To the maximum extent permitted by law, you waive the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding against us. You may bring claims against us only in your individual capacity.

7.4 No jury trial: To the maximum extent permitted by law, you waive any right to a jury trial in any dispute arising out of these Terms or the Services.

7.5 Mandatory rights: Nothing in these Terms excludes or limits liability for intent or gross negligence, or any other right that cannot be waived under Swiss or other mandatory consumer law. Where a waiver is not enforceable, it is enforced only to the extent the law allows.

8. Governing Law

These Terms shall be governed by the laws of Switzerland. The exclusive place of jurisdiction for all disputes is Zurich, Switzerland.
